Explanatory Memorandum
To amend Chapter XIII of the Constitution to include the inspection
of churches and to make provision for dioceses to appoint either an
architect or chartered building surveyor and where appropriate to engage
the services of a suitably qualified conservation specialist.

Bill
To amend Chapter XIII of the Constitution
WHEREAS it is expedient to make statutory provision for the appointment
of diocesan architects or chartered building surveyors and where
appropriate qualified conservation specialists;
AND WHEREAS for such purposes it is necessary to amend Chapter
XIII of the Constitution;
Be it enacted by the Archbishops and Bishops and the clergy and
laity of the Church of Ireland in General Synod assembled in
Dublin in
the year 2005, and by the authority of the same as follows:
- In Section 1 of Chapter XIII of the Constitution of the Church
of Ireland, hereinafter referred to as the said Chapter, after
sub-section (i) there shall be inserted the following:
(j) “Church” shall include Cathedral
- After Section 3 of the said Chapter there shall be inserted
the following section namely:
3A (i) In the year 2006 and triennially thereafter each diocesan council shall
appoint a diocesan architect or chartered building surveyor whose duties and
remuneration shall be fixed by the diocesan council. In respect of churches,
listed buildings, protected structures and buildings of historic significance
and in all other cases where necessary, such diocesan architect or chartered
building surveyor shall engage the services of a suitably qualified conservation
specialist.
(ii) The Representative Body shall have the right at any time to
appoint, at its own expense, an architect or chartered building
surveyor or suitably qualified conservation specialist for the purpose
of
obtaining a report on any church, listed building, protected
structure or building of historic significance.
(iii) The appointment of any person to fill any casual vacancy
arising during the term of office of any appointee under sub-section
(i) above shall be made
by the relevant diocesan council.
